Background of the Parties
The 01st Party (husband) and 02nd Party (wife) were married on 01.12.2014 at Muzaffarpur in accordance with Hindu rites and customs. The marriage was duly consummated, and a daughter, Ms. Xxxxxx Mishra, was born on 09.08.2017. The minor daughter presently resides with her mother.
Subsequently, matrimonial discord arose, leading to multiple proceedings between the parties:
- Matrimonial (Divorce) Case No. 115/2023 (U/s 13 HMA).
- Criminal Misc. Case No. 79011/2024 – pending before Patna High Court.
- Complaint Case No. 678/2021 (U/s 498A, IPC & Sec. 04 DP Act) pending before SDJM, East Muzaffarpur.
- Maintenance Case No. 173/2021 (U/s 125 Cr.P.C.) – pending before Family Court, Muzaffarpur.
Settlement Through Dispute-Eater
A First Motion Petition (MAT 497/2025) was filed jointly by the parties and disposed of on 30.10.2025. Thereafter, a final counselling and settlement session was conducted at the office of the Dispute-Eater. Both parties reaffirmed their earlier understanding that they would not resume cohabitation and agreed to dissolve the marriage by mutual consent.
As per the settlement terms: – The 01st Party (husband) paid a total of ₹14,00,000/- by Demand Draft, executed a deed of gift in respect of the land situated at village xxxxxxxx, Ps- xxxxxxx, District Muzaffarpur in favour of the petitioner no. 02 and her minor daughter on 30.10.2025 vide deed no. 31575. The remaining sum of ₹11,00,000/- (Eleven Lakhs only) shall be paid by the 01st Party to the 02nd Party by way of Demand Draft, to be deposited before the Court at the stage of evidence. The wife shall receive the Demand Draft at the time of the final judgment in the case of Consent Divorce.
Conclusion
Accordingly, all pending disputes between the parties have been amicably resolved. Both parties have consented to end their matrimonial relationship through mutual divorce on the terms recorded above.
The matter, therefore, stands end and has reached a Full-Stop under the Dispute-Eater philosophy.
