The parties to the marriage are the husband and wife. The marriage is a love marriage and an inter-caste marriage. Both parties met when they were students in Class IX at a coaching centre in Muzaffarpur and developed a romantic relationship. After completing their 12th examinations, the husband went to Delhi for further studies, while the wife was admitted to the prestigious MDDM College in Muzaffarpur. They decided to marry despite opposition from their guardians. Initially, they went to Kolkata and then Haryana via Delhi, where they performed their marriage in a temple and started living together.
The marriage was duly consummated, and a daughter named XXXXX Kumari was born on February 15, 2015. However, after some time, disputes arose between them, leading the wife to leave the husband’s house and live separately. She subsequently filed for divorce under case number 153/2024 before the Principal Judge, Family Court Muzaffarpur.
The husband also appeared in the case. With the effort of the “Dispute-Eater” to resolve the dispute, a meeting was held on the court premises in the presence of the wife’s advocate, Mr. Mukesh Kumar. Both parties agreed on the point of divorce and are prepared to file for a consent divorce before the Principal Judge, Family Court Muzaffarpur, on the following terms and conditions: –
- That wife acknowledges and agrees that she has no other claims whatsoever against her husband, nor shall she have any such claims in the future. This includes but is not limited to, claims related to Stridhan, past, present, or future maintenance, permanent alimony, or any other claims arising out of or relating to the present marriage or its dissolution.
- That both parties shall not lay any claim against the property of each other.
- That the parties hereby agree that, apart from Matrimonial Case No. 153/2024, there are no other cases pending between them. The wife agrees to withdraw the said case. Additionally, if there are any other civil or criminal cases or legal proceedings pending between the parties or their family members in any court or forum related to the present matrimonial alliance or dispute, these shall also be withdrawn as soon as possible without unnecessary delay. If any case is not withdrawn by either party, it shall be considered null and void and will not hold any legal validity.
- That except for the above cases no other cases are pending between the parties in any other court either in Muzaffarpur or other than Muzaffarpur.
- That xxxxxxx Kumari shall live with her mother with the risk and consequences of the Petitioner No. 01.
- That the father will have the right to meet her daughter at per convenience prior to consultation with xxxxxx Kumari and/or her guardian (mother).
- That husband opened a recurring deposit (R/D) account in the name of his wife in post office, account number 4970027xxx. If the wife withdrew the amount from this account and use it for the education of xxxxx Kumari, the husband would have no objections.
- That both parties undertake not to interfere in each other’s lives.
- That both parties permanently waive any rights to claim alimony, maintenance, or any property, movable or immovable, including Stridhan, against each other and their respective families, following the terms of the agreement mentioned above.
- That both parties shall cooperate with each other regarding the disposal of the cases pending against each other.
- That both the parties are bound by the aforesaid conditions to cooperate and work towards getting mutual separation as soon as possible. Both shall appear before the court for disposal of the aforesaid cases and in Mutual Divorce Case without fail at their own cost.
- That both parties have no objection if the court dissolves the existing marriage between them, which was solemnized on 26.10.2009 at xxxxx Durga Mandir Haryana according to Hindu rites and customs.
In this way with the effort of the “Dispute-Eater” the dispute between the parties have come to a full Stop.
