Background

Both parties are spouses. Several reconciliation attempts were made in the presence of their parents, local panches, and well-wishers. However, these efforts did not produce any positive results.

Finally, with the intervention and efforts of the Dispute-Eater, managed by the Ram Yatan Sharma Memorial Trust, the matter was amicably settled at the Office of the Dispute-Eater on 09.08.2025.

A separate compromise petition was prepared and duly signed by both parties, their guardians, and witnesses. The parties agreed on the following terms:

Terms of Settlement: –

i. Both parties will jointly file a petition for Mutual Divorce before the Family Court, Muzaffarpur.
ii. Petitioner No. 01 had acquired land through a registered sale deed (Deed No. 14882 dated 30.08.2018), situated at Village Vaidyanathpur @ Khanpur, P.S. Ahiyapur, Musahari, District Muzaffarpur; Thana No. 681, Khata No. 46, Khesra No. 242, area – 04 decimals.

Boundaries: –

North – Reena Devi
South – Self seller
East – Mahendra Shah & Others
West – 15 feet road

iii. This land shall be transferred by Petitioner No. 01, via a registered gift deed, jointly in favour of Petitioner No. 02 and their daughter, xxxxxxx Mishra. All registration expenses will be borne by Petitioner No. 01. After registration, the original sale deed (No. 14882 dated 30.08.2018) will be handed over to Petitioner No. 02.

iv. The said land will be transferred free from all encumbrances. If any encumbrance is found, it will be the responsibility of Petitioner No. 01 to discharge it.
v. Petitioner No. 01 will provide a total of ₹25,00,000/- to Petitioner No. 02, via bank draft, towards maintenance, education, and marriage expenses of their daughter. Out of this, ₹15,00,000/- will be deposited by Petitioner No. 02 in any nationalised bank in the name of xxxxxxx Mishra, and the remaining amount will be at the disposal of Petitioner No. 02.
vi. Out of the total ₹25,00,000/-, ₹14,00,000/- has already been paid via Demand Draft dated 08.08.2025 (DD No. 703410, PNB) in Matrimonial Case No. 115/2023. The balance will be paid at the time of the second motion.
The Sukanya Samriddhi Yojana account (A/c No. 1218-SSA-10) in the name of xxxxxx Mishra, presently maintained by Petitioner No. 01, will be transferred to Petitioner No. 02, who will continue regular deposits.

vii. Petitioner No. 01 has returned all articles/goods belonging to Petitioner No. 02 which were in his possession.

viii. Both parties agree to withdraw all pending cases against each other and their respective family members and undertake not to file any new cases (civil or criminal) in the future.

ix. Neither party will interfere in the personal or professional life of the other. They will also take all necessary steps for quashing/withdrawing any ongoing cases. If any case is not withdrawn, it will be deemed null and void in the eyes of law.
x. Both parties will cooperate in disposing of all pending matters.
xi. The daughter, xxxxxx Mishra, will reside with her mother, under her care and responsibility.
xii. Petitioner No. 02 will not claim any maintenance or alimony in the future, except as provided in this agreement. Both parties permanently waive any rights to movable or immovable property, Stridhan, or any other claims against each other or their families.
xiii. Both parties are bound to cooperate to complete the process of mutual separation at the earliest and will appear before the court as required, at their own cost.
xiv. Both parties have no objection to the dissolution of their marriage (solemnised on 01.12.2014 at Muzaffarpur as per Hindu rites) upon receipt of the balance amount through a banking channel, as permanent alimony.

Conclusion

This settlement ensures a lawful, final, and peaceful resolution of the dispute. The matter between the parties has now reached a Full-Stop.
