06.02.2020: – It is a criminal Dispute but the root cause of the dispute is a piece of land bearing R.S Khata No. 957, RSP No. 2134 measuring an area of 06½ decimals, situated at Village & Po- Chapra Megh, Anchal- Mushahari, district- Muzaffarpur. The facts of the dispute are that the 01st party, the 02nd party and the land-owner are co-villagers. The land-owner had negotiated for the sale of the said land with the 01st party, he took an advance from him and delivered possession over the said piece of land to the 01st party and left his house. After the passage of 20 years-long periods, the landowner came and executed a registered sale deed in favour of the 02nd party and left his house permanently.
Now the dispute was that the 02nd party is the title-holder of the aforesaid land and the 01st party has been coming possession over the said land. The 01st party approached to trust for legal remedy.
The Trust asked a question from him about the possibility of the compromise. The first party told that he had paid advance money for the aforesaid land and he has been coming in peaceful possession over the land for more than 20 years.
The Trust observed that if the 02nd party agreed to return advance money to the 01st party and the 01st party agreed to deliver possession over the aforesaid land to the 02nd party, the dispute between the parties may be solved.
After counselling between the parties, the 02nd party agreed to pay the advance money as given by the 01st party to the original land-lord and the 01st party agreed to deliver possession over the said land to the 02nd party.
Accordingly, the dispute between the parties is settled outside the court. With the the effort of the trust, the court was saved from spending precious time in deciding a contested case. The litigation between the two has now come to a full-stop.
