A dispute had arisen between the Plaintiff and the Defendants for partition and declaring the some deed of sale as void. Consequently, the Plaintiff instituted the present suit seeking, inter alia, a declaration that the sale deed(s) executed by Defendant No. 01 in favour of Defendant No. 2 are illegal, void, and not binding upon the Plaintiffs, as well as a decree for partition of the entire joint family property.
Subsequently, with the intervention of well-wishers and respectable persons, the parties amicably resolved all their disputes. Defendant No. 1 agreed to execute a Deed of Disclaimer in respect of the disputed property and further agreed to partition the entire joint family property.
In pursuance of the said settlement, the entire joint family property has been partitioned between the parties into two equal shares, and each party has entered into peaceful possession and enjoyment of its respective share. Consequently, all disputes and differences between the parties have been amicably settled and have come to a full stop.
In view of the aforesaid amicable settlement, the Plaintiff is no longer desirous of prosecuting the present suit and has, therefore, become ready and willing to withdraw the same.
