A Resident of Mohalla/Village- XXXXX, Po – R.K Ashram Bela Ps- Mithanpura, District- Muzaffarpur, Pin- 843116.
Address of the Wife – XXXXXX S/o Shri XXXXXX Thakur, Permanently Residing at Mohalla/Village -XXXXXX, Ps- Sakra, District- Muzaffarpur, Pin- 843104.

Background of the Parties

The 01st  Party (husband) and 2nd Party (wife) were married on 11.03.2016 at XXXXX Sakra, Muzaffarpur in accordance with Hindu rites and customs. The marriage was duly consummated, and a daughter, Ms. XXXXXXXX, was born on 01.02.2017. The minor daughter presently resides with her mother.

Subsequently, matrimonial discord arose, leading to multiple proceedings between the parties:

  1. Matrimonial (Divorce) Case No. 288/2019 (U/s 13 HMA) – Withdrawn.
  2. Civil Misc. Case No. 614/2023 – pending before Patna High Court.
  3. Complaint Case No. 1763/2019 (U/s 498A, 323, 406 IPC & Sec. 3 DP Act) – pending before JM, 1st Class, East Muzaffarpur.
  4. Maintenance Case No. 276/2019 (U/s 125 Cr.P.C.) – pending before Family Court, Muzaffarpur.
  5. Complaint Case No. 1751/2019 (U/s 12 DV Act) – pending before SDJM East, Muzaffarpur.

Settlement Through Dispute-Eater

A First Motion Petition (MAT 80/2024) was filed jointly by the parties and disposed of on 01.07.2025.

Thereafter, a final counselling and settlement session was conducted at the office of the Dispute-Eater. Both parties reaffirmed their earlier understanding that they would not resume cohabitation and agreed to dissolve the marriage by mutual consent.

As per the settlement terms:

  1. The 01st Party (husband) paid a total of ₹3,50,000/- by cheque. Out of this, an amount of ₹2,50,000/- has been invested as a fixed deposit under Account No. 251800PU00008573 in the name of the daughter, XXXXXXXXX, on 12.2024. This amount shall not be unilaterally withdrawn by the wife.
  2. The remaining sum of ₹4,00,000/- (Four Lakhs only) shall be paid by the 1st Party to the 2nd Party by way of Demand Draft, to be deposited before the Court at the stage of evidence. The wife shall receive the Demand Draft at the time of the final judgment in the case of Consent Divorce.

Conclusion

Accordingly, all pending disputes between the parties have been amicably resolved. Both parties have consented to end their matrimonial relationship through mutual divorce on the terms recorded above. The matter, therefore, stands at an end and has reached to a Full-Stop.
