The plaintiff has filed the suit for declaration of title and recovery of possession over the suit land against the defendants. With the effort of “Dispute-Eater,” the suit is compromised and according to the compromise, the plaintiff executed a sale deed in favour of the defendant no. 02 namely Rakesh Ranjan on 16.05.2023 after receipts of the sale price as mentioned in the sale deed. Today both the parties physically appeared in the office of “Dispute-Eater” and the plaintiff and defendant no. 02 signed in the register of the “Dispute-Eater” and a withdrawal petition is prepared. The same will be filed in court on 12.07.2023, the next date of the suit.  And now, the dispute between the parties came to a full-Stop.

The humble petition on behalf of the Plaintiff u/o- 23 R- 01 of the Code of Civil Procedure

Most Respectfully Sheweth: –

1. That this suit was filed by the Plaintiff for a decree of declaration of title and recovery of possession over the suit land.
2. That with the effort of “Dispute-Eater” the dispute between the parties is settled outside the court and after the said compromise the plaintiff sold the suit property to defendant no. 02A Namely Rakesh Ranjan @ Mukesh Sharma through the registered sale deed dated 16.05.2023 Deed No.13301.
3. That the plaintiff has also abandoned her claim including the cost of litigation against the defendants.
4. That considering the facts & circumstances said above, it would be proper for Plaintiff to withdraw the claim against the Defendants.
5. That the Petition in hand is signed and verified by the Plaintiff and duly supported with an affidavit.

It is, therefore, prayed that the court be pleased to permit the Plaintiff to withdraw the suit against the defendants. And for this, the Plaintiff shall ever pray.

I, Meena Devi aged about 39 years w/o Late Vijay Singh a resident at village – Batraulia, Po- Bakhra, Ps- Saraiya, District- Muzaffarpur  Pin- 843101 do hereby solemnly affirm and declare as

1. That I am the plaintiff in the case and well conversant with the facts of the case.
2. That the content of the withdrawal petition marked “X” for identification is true and correct to my personal knowledge and belief.
3. That the contents of the affidavit are also true and correct. It is submitted that there is nothing false therein nor anything is concealed therein.
