विवाद के तथ्य

सूचक के अनुसार उनके साथ उनके घर में घुसकर अभियुक्तगण ने गाली-ग्लोज और मार-पीट किया था। जबकि अभियुक्तगण का कहना है कि दोनों के बीच जमीन संबंधी विवाद है और उसे गलत तरीके से इस वाद में फंसाया गया है।

अपने ऊपर घटी घटना के कारण सूचक ने औराई थाना में वर्ष 2013 में शिकायत दर्ज कारवाई थी। मामला लगभग 09 वर्षों तक न्यायालय में लंबित रहा। उपरोक्त कांड के सूचक और अभियुक्त दोनों एक ही परिवार के सदस्य है। दोनों के बीच विवाद को समाप्त कराने में महत्वपूर्ण भूमिका श्री राम बोला सिंह नें निभाई। ट्रस्ट कार्यालय में अभियुक्त राम बोला सिंह के साथ आये और सूचक चूंकि महिला है अतः उनकी सुविधा को ध्यान में रखते हुए उन्हें न्यायालय में आने के लिए निवेदन किया गया। दोनों निर्धारित तिथि को न्यायालय में आये। दोनों की काउंसेलिंग की गई। तत्पश्चात दोनों विवाद को समाप्त करने के लिए सहमत हो गए। दोनों के बीच में एक संधि-पत्र तैयार किया गया और उसे न्यायालय में प्रस्तुत करके डिस्प्यूट – ईटर लगभग 09 वर्षों से न्यायालय में लंबित उपरोक्त विवाद को पूर्ण विराम तक पहुंचाने में सफलता प्राप्त किया है।

The humble compromise petition on behalf of the parties most respectfully

Most Respectfully Sheweth: –
1. That with the effort of “Dispute-Eater” a wing of Ram Yatan Sharma Memorial Trust Muzaffarpur” the case is compromised between the parties outside of the Court.

2. That the learned court has taken cognizance on 04.2017 u/s 323, 341, 504 IPC. All the sections are compoundable without permission of the court.

3. That due to compromise the parties do not want to contest the case further.

4. That witnesses of the parties also do not want to depose before the court.

5. That the support of the compromised parties, as well as their lawyers, have been signed over the compromise.

It is, therefore, prayed that the court be pleased to accept the compromise and the case be disposed-of  according to the compromise. And for these parties shall ever pray.
