Background of the Parties

The 01st  Party (husband) and 2nd Party (wife) were married on xxxxxxx at Muzaffarpur in accordance with Hindu rites and customs. Subsequently, matrimonial discord arose, leading to multiple proceedings between the parties:-

  1. Matrimonial (Restitution) Case No. 112/2021 under Section 9 of the Hindu Marriage Act, pending before the Court of the Principal Judge, Family Court, Muzaffarpur.
  2. Complaint Case No. 677/2024, pending before the Court of Judicial Magistrate, 1st Class, Court No. 08, Muzaffarpur (East).
  3. Maintenance Case No. 310/2023, pending before the Court of the Principal Judge, Family Court, Muzaffarpur.
  4. Complaint Case No. 553/2021, pending before the Court of the Sub-Divisional Judicial Magistrate (SDJM), Muzaffarpur.

Settlement Through Dispute-Eater

A First Motion Petition (MAT 667/2025) was filed jointly by the parties and disposed of on 11.12.2025. Thereafter, a final counselling and settlement session was conducted at the office of the Dispute-Eater. Both parties reaffirmed their earlier understanding that they would not resume cohabitation and agreed to dissolve the marriage by mutual consent.

As per the settlement terms:

  1. The 01st Party (husband) paid a total of ₹12,00,000/- through RTGS/Demand Drafts.
  2. The remaining sum of ₹4,00,000/- (Four Lakhs only) shall be paid by the 1st Party to the 2nd Party by way of Demand Draft, to be deposited before the Court at the stage of disposal of 02nd motion. The wife shall receive the Demand Draft at the time of the final judgment in the case of Consent Divorce.

Conclusion

Accordingly, all pending disputes between the parties have been amicably resolved. Both parties have consented to end their matrimonial relationship through mutual divorce on the terms recorded above. The matter, therefore, stands end and has reached a Full-Stop under the Dispute-Eater philosophy.
